Booking Conditions – Please Read These Conditions Carefully Booking & Deposit All bookings must be accompanied by a 50% deposit, or in the instance of the booking being made within nine weeks of the departure date, by the full cost of the reservation. Insurance All insurances, medical or otherwise, are the responsibility of the client. Liability Verbier Chalets Limited (hereafter referred to as VCL) does not accept liability for the actions or omissions of those involved in the holiday arrangements over whom VCL has no direct control and/or who are not employed by VCL as servant or agents including but not limited to persons providing transportation services namely airlines, bus companies, train companies, ski lift operators, taxi operators, the owners or operators of any vehicle, aircraft or equipment or any of their proprietors or employees. Description Accuracy All information about accommodation is rigorously scrutinised to ensure that it is correct. However, the client should bear in mind that in relation to the information given about the resort it is more difficult to guarantee accuracy as very few of the facilities are under our management and they may be changed between the time we publish our information and the time you go on holiday. VCL also point out that some foreign countries general standards of hygiene, care, public services and efficiency may differ from those of the United Kingdom and that the client should accordingly exercise greater care for his own protection and health. VCL must draw attention to the fact that they cannot in any way guarantee the weather and snow conditions, this being outside of their control. Cancellation of Holiday In view of the fact that holiday arrangements are made many months in advance, changes may sometimes have to be made. VCL will not cancel a holiday or other travel arrangements after the date when payment of balance of the price becomes due unless it is necessary to do so as a result of factors outside VCL’s control, or unless the client defaults in payment of the balance of the holiday price. If VCL for reasons other than for factors outside of their control cancels a holiday on or before the date when payment of the balance of the holiday becomes due VCL will offer the client the choice of an alternative holiday of at least comparable standard (if available) or a prompt and full refund of all monies paid. If VCL has to cancel a holiday as a result of factors outside of their control, VCL will inform the client without delay and offer the client the choice of an alternative holiday of at least comparable standard (if available) or a prompt and full refund of all monies paid. Alteration of a holiday booking by VCL It is unlikely that VCL will have to make any changes to a holiday but if this becomes the case VCL will inform the client and the client will have the choice of accepting the changed arrangements or purchasing another available holiday, or the client may wish to cancel in which case the client will receive a refund of all monies paid to VCL. Cancellation of holiday by client A cancellation by a client will only be effective when notification has been received by VCL. A cancellation must be in writing and signed by the person who signed the booking form. If cancellation is prior to four weeks before the date of departure the 50% holiday deposit will be forfeited, if the cancellation is within four weeks of the date of departure 100% of the booking fee will be forfeited. If a client wishes to alter a booking which has been accepted in writing by VCL an alteration fee of 10% of the booking fee will be applicable, if VCL cannot accommodate the alteration VCL will be entitled to treat the request as a cancellation and the above forfeits will apply. Holiday documents Upon receipt of full payment VCL will sent the client a booking confirmation, including details of the procedure upon arrival in resort. Damage caused by Clients. All clients agree on making a booking not to cause any damage to any chalet, apartment, hotel or their contents. The client will be fully responsible for any damage or loss he causes to any property or their contents and VCL shall be entitled to recover the amount of all claims (including the cost of repairs executed to VCL’s satisfaction) in respect there of from the client. A damage deposit will be taken as security against any damage that may be incurred. Weather Conditions VCL will not be responsible for any loss, delay or costs connected with adverse weather conditions. Limitation on Liability When staying in our properties VCL liability is limited to the full extent permitted by the law. When travelling by air or by ship or by other conveyance the conditions of carriage of that airline or shipping company or other conveyance will apply. These conditions may exclude or limit liability. In respect of travel by air, bus, rail, car or other conveyance this contract shall be subject to the same terms and those between VCL and the carrier. Where VCL’s conditions conflict with those conditions VCL’s conditions will prevail. The attention of the client is specifically drawn to the fact that carriage by air may be subject to the provisions of the Warsaw Convention of 1929 and/or the Warsaw Convention as amended by the Hague 1955 and the IATI Conditions of Carriage. Claims by the Client against VCL Any contract made between the client and VCL shall be governed in all respect by English Law and the English Courts only shall have any jurisdiction in relation to any claim or dispute arising out of or connected with any such contract. VCL accepts no responsibility for the actions of it’s clients and shall not be held liable for any claim made against them (or as a result of their actions) either by other clients of VCL or third parties. Any claim or complaint shall be notified to the representative employed by VCL during the holiday who will do their best to help the client at that time. If a matter cannot be resolved complains or claims must be notified in writing to VCL by the claimant within 28 days of the completion of the holiday. |
